Returns / Warranties/Buyer’s Agreement

BUYER'S AGREEMENT
The buyer agrees to pay any and all collection and/or recovery costs if the buyer's credit card card company refuses (for whatever reason) to pay the charges to Action Center llc. The buyer agrees to provide sufficient, reliable, and accurate information to Action Center llc - name, address, e-mail address, and telephone number - for Action Center llc. to be able to verify the legitimacy of the transaction; and The buyer represents that he or she is over the age of eighteen (18).

30 day guarantee new or used merchandise may be returned for refund or store credit within 30 days of the invoice date. Action Center llc. will not accept returns after 30 days from the invoice date . All returned items must be complete and in the original packaging. Returned items must include all warranty cards, instructional manuals and associated parts. A copy of the original invoice must accompany all returns. Please save the original invoice for your records. You may need it for other items or future warranty claims. Paintballs, clothing , and batteries may not be returned.

Restocking  fees.  All returns are subject to a 20% restocking fee Any item returned used or not in its original condition or entirety or damaged will be subject to a minimum 40% restocking fee. Additional charges can be up to 80% of the original purchase price for excessive use or damage. Use is defined by any attempt to air up or fire a marker or install accessories. The customer is responsible for all shipping charges associated with returned items. Action Center llc. will only issue a refund after a return has been received and reviewed. The amount refunded will reflect the original cost of the item minus shipping fees and restocking fees associated with the return as stated above. If the product qualified for free shipping and it is returned the customer will pay the original shipping charges which were paid by Action Center llc.

Returning Product.  You must contact us by e-mail or phone for a return authorization number. No returns will be accepted without this authorization. Any packages shipped back to us without this number on it will be refused and returned to the sender.

Warranties
All new paintball equipment carries warranty by the corresponding manufacturer. The length of a warranty, extent of its coverage and the terms of warranty service vary according to each manufacturer. All warranty related questions or claims must be directed to the manufacturer of the product. Action Center llc. is not responsible for shipping charges incurred on items returned for warranty or service issues. Action Center llc. does not guarantee any claims regarding any item's ability to perform as stated or advertised by the manufacturer. Never attempt to use, fix or alter a damaged item. This may void the warranty for that item. Action Center llc. does not offer a warranty or warranty service on any product. Action Center llc. is not responsible for any damage that occurs during the shipment of any product including paintballs. Transit handling and climate conditions can alter the quality of paintballs. Please take temperature changes into consideration when placing orders for paintballs, Action center does not exchange product. Any item that you wish to exchange due to malfunction or failure to operate must be returned to the manufacturer.

CLAIMS
Action Center llc. inspects, and weighs, each order to insure its accuracy before shipping. Claims of shortages must be reported by phone (801-876-3132) or e-mail (jeff@actioncenterpaintball.com) within 48 hours of delivery of the order. After 48 hours no claims will be honored. For damaged items the customer must contact the shipping company first 1800pickups. The customer must retain the original shipping carton and packaging materials in the event that it becomes necessary to file a UPS missing item or damage claim.

CANCELLATIONS
If, after placing an order with Action Center llc., you decide that you do not want the order, you must cancel the order by phone (801-876-3132) before we process it. If you cancel before we process it there with be no charges to your card. If you cancel your order after Action Center llc . has processed it, you are still responsible for the costs associated with processing the order which is 4% of the order total. Process cutoff time is 4.00 PM mst Refusing to accept the delivery of your order does not constitute a cancellation of that order. You are still responsible for all costs associated with shipping the order to you, and the restocking fees.

Action Center llc. expressly disclaims any responsibility or liability for any damage, loss or injury arising out of your purchase or by the use of the goods sold by our store. Except as expressly stated herein, Action Center llc.. makes no representations or warranties, either express or implied, of any kind with respect to products sold by Action Center llc. Except as expressly stated herein, Action Center llc. expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Action Center llc. arising from any product sold on Action Center llc. site shall be the price of the product ordered. In no event shall Action Center llc., its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold. You agree that Action Center llc its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of the Action Center llc site. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages. Please note that "paintball equipment" may be prohibited or restricted in your area. The buyer should follow all local laws and ordinances in their state regarding paintball equipment, including age limitations on purchases. Please check before you order. Action Center llc . will not accept returns on the basis of the restrictions imposed in your area.

Typographical Errors
Action Center llc., reserves the right to change prices and terms without notice. All prices and products are subject to availability. In the event a product is listed at an incorrect price, or with incorrect information received from our suppliers, Action Center llc. shall have the right to refuse or cancel orders.

Jurisdiction and Venue
You agree that any legal action brought against . Action Center llc. shall be governed by the laws of the State of Utah without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of, or orders made on the Action Center llc. site shall be an appropriate federal or state court located in Morgan County, Utah.
